Judge pauses California request to bar Trump use of national guard troops

Charles Breyer, who ruled that president broke law by sending troops to LA, declines to make immediate ruling

A federal judge who ruled last week that the Trump administration broke federal law by sending national guard troops to the Los Angeles area said on Tuesday he will not immediately consider a request to bar the use of 300 guard troops.

In a court order, senior district judge Charles Breyer in San Francisco said he was not sure he had the authority to consider California’s motion for a preliminary injunction blocking the administration’s further deployment of state national guard troops. That is because the case is on appeal before the ninth US circuit court of appeals, the judge said.
